Please read the following terms carefully to ensure a safe and clear experience on the Wazifatuk Alayna platform.

1. Introduction and Acceptance of the Terms

These Terms and Conditions ("the Terms") govern your use of the "Wazifatuk Alayna" platform ("the Platform" or "we") via wdeftksa.com, its official apps on the App Store and Google Play, and any related subdomains (such as app.wdeftksa.com, company.wdeftksa.com, and a.wdeftksa.com). By accessing, using, registering with, or applying to a job through the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms and the complementary "Privacy Policy." If you do not agree, you must stop using the Platform.

Legal basis: the Civil Transactions Law (formation of a contract by offer and acceptance and the validity of electronic contracting), and the E-Commerce Law issued by Royal Decree no. (M/126) and its Implementing Regulation regarding disclosure and electronic contracting.

2. Definitions

The Platform: the "Wazifatuk Alayna" website, apps, and services.
The Operator: Wazifatuk Alayna (Alayna Electronic Services Office), the entity that owns and operates the Platform.
User/Job Seeker: any person who browses the Platform, creates an account, or applies to a job.
Publisher/Employer: any establishment or entity that posts a job listing or receives applications via the Platform.
Content: job listings, texts, data, and materials displayed on the Platform.
Paid Services: any service for a fee (such as the "Career-Boost" résumé-preparation service), once activated.

3. Eligibility and Age

Use of the Platform is intended for those aged 18 years or older. If you are younger, you may not use the services except with the consent and supervision of a legal guardian as permitted by law. You represent that the data you provide is true, accurate, and belongs to you, and impersonating others is prohibited.

4. Nature of the Platform: An Intermediary/Publisher, Not an Employer

This section is essential and is read together with the "Privacy Policy":

"Wazifatuk Alayna" is a platform for aggregating and displaying job listings (from public sources and from publishing entities) and enabling applications to them. We are not the employer, and we are not a party to any employment relationship arising between you and the publishing entity.
We do not guarantee employment, obtaining an interview, or any outcome from applying.
We do not guarantee the accuracy, correctness, currency, or legality of every job listing posted by a third party, nor the working conditions, wages, or identity of the publishing entity. Some listings are displayed as quoted from public sources.
Warning about job fraud: fraudulent listings may appear despite our review efforts. We will never ask you to pay any amounts in exchange for employment, and you should not pay any fees to any entity in exchange for a job via the Platform. Beware of any request for fees, banking data, or sensitive documents in exchange for a job, and report it to us immediately via support@wdeftksa.com.
Any contractual relationship or labor dispute arising between you and the publishing entity is strictly between you two, is governed by the Labor Law and the regulations of the Kingdom, and falls within the jurisdiction of the competent authorities (labor courts/Ministry of Human Resources and Social Development) without any liability on the Platform.

Legal basis: the Labor Law and its Implementing Regulation — an employer's obligations do not apply to a display/publishing intermediary; the Platform remains a display and matching service provider.

5. Account and Registration

Registration on the Platform is free for job seekers. You undertake to provide true and up-to-date data and to keep your login credentials confidential, and you are responsible for all activity conducted through your account.
We may suspend or terminate the account upon violation of these Terms or upon suspicion of fraudulent or unlawful activity.
You may request deletion of your account via the channels set out in the "Privacy Policy," and via the in-app account-deletion path where available.

6. Applying to Jobs

When applying to a job, you provide data including name, email, mobile number, an optional cover letter, and any additional fields the employer defines.
Your application data is transferred to the entity publishing the job to assess your application, and that entity becomes an independent controller of that data after receiving it. You agree to this transfer by submitting the form.
You alone are responsible for the accuracy of what you provide. Submitting fake, automated, or duplicate applications for abusive purposes is prohibited.

7. Company and Publisher Accounts

Via company.wdeftksa.com, the Platform enables establishments to create accounts, manage a team, post jobs, manage applicants, verify, and handle billing/wallet.

Job posting and publisher obligations are subject to the Job Posting and Employer Terms, and include: listing accuracy, non-discrimination, and protection of applicant data.

8. Paid Services (Subject to Activation)

The Platform's design provides the paid "Career-Boost" service to prepare a résumé and professional documents with AI assistance (intake form on a.wdeftksa.com).

The payment technical infrastructure (the payment gateway pay.wdeftksa.com via the Moyasar provider) exists in the Platform, and once payment is activated, the billing and 15% VAT provisions apply.

Paid-service provisions, once activated, include: disclosing the price inclusive of tax before payment, issuing an invoice, and clarifying the nature of the service (custom content/service whose execution begins after the order) and its effect on the right of withdrawal under the E-Commerce Law.

Legal basis: the E-Commerce Law (M/126) and its Regulation, and the E-Invoicing and VAT law/regulation issued by the Zakat, Tax and Customs Authority (ZATCA).

9. Advertising (Google AdSense)

The Platform displays third-party ads via Google AdSense as a primary revenue channel (publisher ID ca-pub-3335862771619351).

The appearance of any ad does not constitute a recommendation or a guarantee from the Platform for the advertiser, its product, or its service. Dealing with advertisers is at your own responsibility. Processing of cookies and advertising data is governed by the "Privacy Policy."

The user is prohibited from hiding ads by fraudulent means, automated or fraudulent clicking, or any behavior that violates Google's policies or harms the Platform.

10. Acceptable Use

Every user and publisher undertakes to comply with the Acceptable Use Policy, which prohibits — by way of example and not limitation — fraud, posting fake or discriminatory jobs, misusing the forms, unlawful access, impersonation, or any use that violates the Anti-Cyber Crime Law issued by Royal Decree no. (M/17).

11. Intellectual Property

All intellectual property rights in the Platform and its content (software, interface and UX design, logos, texts, databases, and the "Wazifatuk Alayna" trademark) are owned by or licensed to the Operator and are protected by the applicable regulations in the Kingdom.
The user is granted a limited, non-exclusive, non-transferable, revocable license to use the Platform and its app for personal, non-commercial purposes limited to searching for and applying to jobs.
Copying, reproducing, distributing, modifying, or republishing any part of the Platform's content, design, or trademark without prior written permission is prohibited.
If you believe that content on the Platform infringes intellectual property rights of yours, report it to us via info@wdeftksa.com with proof of the right, and we will take appropriate action.

12. User-Provided Content

Ownership of what you provide (such as the cover letter or the résumé uploaded in the Career-Boost service) remains yours, and you grant the Platform a limited license to use it to the extent necessary to perform the service you requested (running the application, preparing the documents, and transferring the application to the publishing entity).

You represent that what you provide does not infringe the rights of others and does not contain unlawful content, and you alone are responsible for it.

13. Disclaimer of Warranties

The Platform and its services are provided "as is" and "as available" without express or implied warranties regarding the accuracy, completeness, error-freeness, or continued availability of the content.
We do not guarantee that the Platform is free from interruption, technical errors, or malware; you are responsible for taking appropriate protective measures for your devices.
We do not guarantee the results of the Career-Boost service (once activated) in terms of obtaining a job; it is merely an assistive document-preparation service.

14. Limitation of Liability

To the extent permitted by law:

The Platform or the Operator shall not be liable for direct, indirect, or consequential damages arising from the use of the Platform or the inability to use it, or from dealing with a publishing entity, advertiser, or external site.
The Platform shall not be liable for any loss resulting from a fraudulent or inaccurate job listing posted by a third party, while we undertake to take action upon report.
The Platform shall not be liable for the employment relationship or its disputes between you and the publishing entity.

This limitation of liability may not be construed in a manner that forfeits rights legally granted to the consumer or the data subject; the mandatory provisions of Saudi regulations remain in force notwithstanding any conflicting clause.

15. Indemnification

You agree to indemnify the Platform, the Operator, their employees, and affiliates against any claims, damages, or costs (including reasonable litigation fees) arising from your violation of these Terms, the regulations, or the rights of others, to the extent permitted by law.

16. Data Protection

Processing of your personal data is subject to the "Privacy Policy," which complies with the Personal Data Protection Law (PDPL) issued by Royal Decree no. (M/19) and its Implementing Regulation. Your rights as a data subject are exercised in accordance with that policy.

17. External Links and Services

The Platform may include links or integrations to third parties (such as Google or Cloudflare) that operate under their own independent policies. We are not responsible for those parties' content or policies, and reviewing them before dealing with them is at your own responsibility.

18. Amendment and Termination

The Operator may amend these Terms at any time and publish the updated version on the Platform with a revised review date; your continued use after publication constitutes acceptance of the amendment.
The Operator may suspend or terminate your access to the Platform in whole or in part upon violation of the Terms or for a regulatory requirement, without prejudice to rights acquired before termination.
You may stop using the Platform and delete your account at any time.

19. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the regulations of the Kingdom of Saudi Arabia.
The competent judicial authorities in the Kingdom have jurisdiction over any dispute relating to these Terms or the use of the Platform.
Excluded from this are employment-relationship disputes between the user and the publishing entity, which fall within the jurisdiction of the labor authorities (labor courts/Ministry of Human Resources and Social Development), and the Platform is not a party to them.

20. General Provisions

If any clause is held invalid, the remaining clauses remain in force.
The Platform's failure to exercise any right does not constitute a waiver of it.
These Terms, together with the "Privacy Policy," the Acceptable Use Policy, the Cookie Policy, and (once payment is activated) the Refund Policy and Job Posting Terms, constitute the entire agreement between you and the Operator regarding use of the Platform.
